Florida Statutes §§ 768.16-768.26 (2011) are collectively referred to as the "Florida Wrongful Death Act," a law passed with the intention of transferring the economic burdens of a fatal accident from the surviving family members to the party who is at fault for the death. The Act includes a comprehensive list of damages that may be recovered by the plaintiff in a wrongful death claim, including the value of loss of support and services as well as the amount your family could reasonably have expected to receive in income from the decedent. These figures may be computed with interest. Additionally you can claim damages for loss of companionship and mental pain and suffering, as well as compensation for the costs of medical treatment and burial expenses.
