Naples Motorcycle Accident Attorney

Fighting for the Rights of Injured Riders in Naples, FLMotorcycle accident with a car

Hurt in a motorcycle accident? As early as possible after you or a loved one has been injured in a motorcycle crash in Florida, contact a Naples motorcycle accident attorney at Pittman Law Firm, P.L. for a consultation to discuss the situation and learn whether you have grounds for legal action. Attorney David Pittman, the firm’s founder, has been an enthusiastic motorcycle rider since the age of fourteen, a background which gives him a unique advantage in being able to analyze accidents of this type to determine the cause and to accurately estimate the scope of the victim's injuries. It is simply distressing to hear the "excuses" time and time again that "I didn't see the motorcycle." In fact, it is surprising that many people who cause an accident with a motorcyclist often believe the motorcyclist to be at fault just for riding a motorcycle.

This doesn’t sit right with us. Our goal is to obtain bikers the full amount of just compensation they deserve after a motorcycle accident, as well to see to their recovery with compassion and respect.

Motorcycle Accident Statistics

The Florida Department of Highway Safety and Motor Vehicles reports that there were 7,484 motorcycle accidents in our state in 2010, which led to 6,686 injured riders and 350 fatalities.

Approximately 29% of motorcycle accident deaths involved a traumatic brain injury (TBI), while 35% occurred due to injuries to multiple areas of the body. Among survivors who were hospitalized, 35% suffered an injury to the foot or leg, 23% received treatment for injuries to the internal organs, and 20% had sustained a traumatic brain injury.

David Pittman has stood by the bedside of riders who have lost legs, arms, been forced to use a wheelchair for life, and even comforted families who unfairly lost their loved ones for reasons that simply make no sense. David is passionate about representing fellow riders and will not allow your misfortune to be treated lightly.

What are Florida Motorcycle Laws?

Motorcycle accidents are becoming more common as roads are getting busier. To keep drivers safe, Florida has a number of laws that are required for motorcycle riders in order to ensure their utmost safety.

The following are required for any motorcycle riders in Florida:

  • Motorcycle headlights
  • Helmets
  • Protective eyewear
  • Personal Injury Protection (PIP) insurance coverage

According to Florida Statutes 316.211, which details the above, “a violation of this section is a noncriminal traffic infraction” meaning you “must be cited for such an infraction and…appear before an official.” Aside from receiving a traffic ticket, not adhering to the above can lead to serious consequences. Helmets reduce the risk of death by 37% (and the risk of head injury by 69%) and without PIP, you may find it very hard to cover all your medical expenses if severe injury occurs.

Compensation for Motorcycle Accident Injuries

According to the Florida Department of Highway Safety and Motor Vehicles (DHSMV), the median hospital charge for a motorcycle accident injury is $55,748. Whether your injuries have cost you more or less than this amount, you should not be forced to shoulder such a financial burden when another person is at fault.

If your crash was caused by another person's negligence, we want to help you claim the financial compensation you deserve. Compensation that may be available includes:

  • All of your past and future medical expenses related to the accident
  • Lost earnings (if you had to take time off work for recovery)
  • Pain and suffering, including emotional anguish and trauma
  • Funeral and burial expenses (if wrongful death resulted from the crash)

Common Motorcycle Accident Causes & Injuries

Due to the impact that a motorcyclist receives from a vehicle and after making contact with the ground and/or other vehicles, riders are often in no position to argue with or even describe their account of the accident.

Unfortunately, riders often suffer serious injuries, including:

  • Road rash
  • Disfigurement
  • Spinal cord damage
  • Traumatic brain injury
  • Broken bones

Distracted or reckless drivers cause a large percentage of collisions between motorcycles and automobiles and deserve to be held responsible for any resulting injuries. Even the most trained and defensive motorcyclists cannot protect themselves against a driver paying little or no attention to others on the roadways.

Motorcycle accidents can have numerous causes, but some of the most common in injury claims include:

  • Distracted driving, like texting or eating while driving
  • Driving while intoxicated due to alcohol or drugs
  • Motorists not looking out for motorcycles, which most commonly manifests as a passenger vehicle making a turn into a biker
  • Poor road conditions, such as potholes

Whether the driver was texting on a cell phone, was under the influence of alcohol, or was speeding or driving aggressively, we will determine who is at fault and do everything possible to help you secure justice.
