Naples Florida Wrongful Death Lawyer

Suing for the Loss of a Loved One

When you have lost a family member to a fatal accident, there is nothing you can ever do to replace your tragic loss. If the accident was the result of another person's negligence, reckless behavior or malicious actions, you have a right to file a wrongful death lawsuit with the goal of recovering monetary damages.

While no amount of money can undo what has happened, you may at least be able to receive a settlement to defray the significant financial impact of the accident and to help you move on from this horrible experience. We have represented many families who have lost their loved one. The hardest part for many of these families is dealing with the financial responsibility of maintaining the household when the deceased loved one provided substantial financial support to the family. This is simply not fair and the innocent should not be left holding all the weight of the family expenses due to the negligence or recklessness of another.

What damages are recoverable in a wrongful death claim in Naples, Florida?

Florida Statutes §§ 768.16-768.26 (2011) are collectively referred to as the "Florida Wrongful Death Act," a law passed with the intention of transferring the economic burdens of a fatal accident from the surviving family members to the party who is at fault for the death. The Act includes a comprehensive list of damages that may be recovered by the plaintiff in a wrongful death claim, including the value of loss of support and services as well as the amount your family could reasonably have expected to receive in income from the decedent. These figures may be computed with interest. Additionally you can claim damages for loss of companionship and mental pain and suffering, as well as compensation for the costs of medical treatment and burial expenses.

Although the Statute spells out in broad strokes the compensation recoverable, it is up to us as your attorney(s) to prepare your case diligently with an eye towards every detail. Many people do not consider important factors when taking into economic losses such as inflation and net present value. It cannot be emphasized enough how important assembling the right resources and professionals to evaluate your losses are in proving the case and your losses. We do not take this responsibility lightly!
